The WRC dismissed a gym manager’s constructive-dismissal complaint against a gym owner, finding that she had not used the grievance process before resigning. Adjudication Officer Roger McGrath dated the decision 15 February 2018. The manager said the owner’s treatment, disciplinary proceedings and proposed transfer left her with no choice but to resign. The owner said it had offered an independent third party to hear her concerns. The officer found that the proposed transfer did not justify resignation and that the manager’s failure to use the grievance process, including declining the offer, undermined her complaint. Her Payment of Wages complaint was withdrawn at the outset of the first hearing.
