WRC rejects general operative’s unfair dismissal complaint

By Orla Quinn

Workplace Relations Commission ·

The WRC found that a general operative was not unfairly dismissed after he misled his employer about why he was off work. The decision was dated 4 April 2018.

The worker had been employed for about 17 years and said the employer had not considered why he needed time away. The employer said he had misrepresented his illness to obtain sick pay. The adjudicator accepted there were procedural shortcomings, including that one person handled the investigation and decision, but found they did not make the dismissal unfair.
