The WRC rejected a relief home support worker’s constructive dismissal claim, finding she had not shown that her resignation was justified. A separate Payment of Wages Act complaint was withdrawn at the hearing. Adjudication Officer Peter O’Brien dated the decision 15 November 2017. The worker said a lengthy investigation into an allegation against her and reduced hours after her return led her to resign. The care company said it investigated the allegation, paid her during suspension, lifted the suspension after finding insufficient evidence, and offered her the same hours. The WRC found the investigation was necessary, the worker had not raised an internal grievance, and the evidence did not show reduced hours or victimisation. It concluded that there was no substantial breach of her employment rights and that her resignation was not reasonable on the evidence.
