The WRC found that an employee was unfairly dismissed and ordered the employer to re-engage him from 1 January 2018, with no break in service or pension contribution. The decision was dated 1 February 2018.
The employee had worked for the employer since 1999. The employer said it offered to take him back into the same position after learning he was fit to return, but he refused the offer and wanted compensation. The WRC found the employer began its review before its own 12-month absence policy point and did not give him fair notice that dismissal was being considered. It also found he had made little effort to find other work and considered re-engagement the appropriate remedy.
