WRC awards product manager €3,000 over contract, while finding retirement was not dismissal

Workplace Relations Commission ·

The Workplace Relations Commission ordered an importer and distributor to pay a former product manager for unpaid holidays, a breach involving written employment terms and notice pay. The decision was dated 4 April 2018. It ordered €3,000 compensation after finding the employer had not issued him a contract, and €1,884.62 for seven days of unused holidays, plus €1,000 compensation for the holiday rights breach.

The WRC also ordered €1,346.51 in notice pay. The findings state a different amount, €1,346.15. The adjudicator found the product manager retired rather than being dismissed, so his unfair dismissal complaint failed. The decision found both sides contributed to a misunderstanding about work after 65, but overall responsibility rested with the employer. The redundancy complaint was withdrawn.
