Hotel ordered to improve working-time records after WRC complaint

By Aoife Loughran

Workplace Relations Commission ·

The WRC partly upheld a hotel employee’s working-time complaint and ordered the hotel to keep full records of breaks and working hours. The decision was dated 1 May 2018. The employee also complained about changes linked to a transfer of undertakings. The WRC found that complaint was too late and, in any event, that the employee’s contractual terms had not changed apart from a minor matter the hotel agreed to correct. The transfer complaint was not upheld. The employee’s equality complaint was withdrawn. The employee, who had worked for the hotel since 2011, said there had been inadequate consultation about employer changes and problems with the provision and recording of rest breaks. The hotel acknowledged that its break-recording procedures had been inadequate. The officer described the record-keeping breach as minor and ordered the hotel to comply with the requirements going forward.
