WRC rejects roofer’s claim for notice pay from construction company

By Orla Quinn

Workplace Relations Commission ·

The WRC found it had no scope under the Redundancy Payments Act to award a roofer payment in lieu of notice. The worker sought eight weeks’ pay after a construction company told him it was closing and made him redundant with immediate effect. The company did not attend the hearing; the worker did. The WRC decision, dated 3 October 2017, said the worker had received statutory redundancy entitlements from the Social Insurance Fund. It noted that minimum notice legislation could provide for notice or pay in lieu, but the complaint was brought under the Redundancy Payments Act, which did not allow that award.
