The Workplace Relations Commission set aside a quality co-ordinator’s incremental-pay claim, finding it had no jurisdiction over a collective dispute involving a body of laboratory workers. The merits were not decided. In a decision dated 30 April 2018, the adjudicator said the matter should be addressed through collective negotiations and, if needed, further conciliation or a Labour Court hearing. The worker said he had remained at point 4 on a 10-point scale after management froze and abolished increments, despite later local pay increases. The soft drinks company said a 2014 agreement with SIPTU and other unions had treated legacy increment scales as closed issues. The adjudicator found the dispute concerned laboratory workers on different old and new pay arrangements and noted that the issue had already gone to WRC conciliation twice without progress. He concluded that an adjudication officer had no jurisdiction over a body-of-workers claim under the Industrial Relations Act 1969.
