The WRC recommended reducing a food processor worker’s written warning to a verbal warning and paying him for one night’s shift after he missed a consultant’s appointment. Adjudication Officer Emer O’Shea dated the recommendation 8 May 2018. The general operative said the car taking him to Galway broke down on the way to the appointment. The employer said he had not contacted the company about missing the appointment or work. The adjudicator found it reasonable to expect the worker to contact the employer, but considered the written warning excessively harsh because he had attended previous appointments and the company had an escalating sanctions procedure. The WRC recommended paying him for the first night off, which had been approved, but did not uphold his complaint about pay for the second night.
