WRC recommends transport company honour worker’s contract from 2011

By Aoife Loughran

Workplace Relations Commission ·

The Workplace Relations Commission recommended that a transport company implement a worker’s signed employment contract retrospectively from 4 April 2011 and pay the salary adjustment and other benefits due under it. The recommendation was dated 23 May 2018. The worker sought appointment to the company’s regular staff, which would provide access to pension and welfare schemes. The company said its chief medical officer had put her appointment on hold after finding her fit for her current duties. The adjudication officer found that the worker had been deemed medically fit when she signed the revised contract in October 2012. The contract did not provide for ending it because of a later medical assessment, so the WRC recommended that it be implemented and that she receive the salary adjustment and benefits that applied from the contract’s start date.
