The Workplace Relations Commission found that a merchandiser was entitled to a redundancy lump sum after her employer failed to show that her job transferred under TUPE. The decision was dated 23 November 2017. The worker said her employer ended her job after losing a retail merchandising contract, and that the new contractor later hired her. The company argued that her employment transferred to the new contractor, so no redundancy payment was due. The WRC found no evidence that TUPE applied and that the company had terminated her employment. It ruled that she was entitled to a lump sum calculated using weekly gross pay of €78.76 and her employment dates.
