WRC rejects sales assistant’s disability claims against retail store

By Saoirse Doyle

Workplace Relations Commission ·

The Workplace Relations Commission found that a retail store did not discriminate against a sales assistant or fail to provide reasonable accommodation after moving her from checkout work to hygiene duties. The decision was dated 6 March 2018. The assistant said the manual duties were difficult for her and that the store had not assessed her needs or considered other roles. The store said operational needs and a customer complaint prompted the move, and that her sales assistant role covered varied duties. The adjudicator found no evidence that she could not perform the work or that the move adversely affected her disability. Her separate unfair dismissal complaint was withdrawn at the hearing.
