A security officer’s Payment of Wages Act claim for personal attack benefit failed at the WRC after he was injured while pursuing a man in a hospital emergency department. Adjudication Officer Peter O’Brien, in a decision dated 25 April 2018, found that he was not in danger of being injured by the man and that his problem appeared to have arisen from hitting a desk during the pursuit. The security company argued that the injury arose from contact with the nurses’ station, not an attack. The officer argued the benefit was due under the Employment Regulation Order and sought compensation for the alleged underpayment. The WRC found he had not established a right to payment under the regulation, so the Payment of Wages Act complaint failed. His related Industrial Relations Act claim was premised on that complaint succeeding, and the adjudicator made no recommendation in his favour.
