The WRC awarded a supervisor €9,650 for unfair dismissal and €6,176 in minimum notice compensation after finding that a community organisation’s disciplinary process was flawed. The decision was dated 2 February 2018.
The worker, who had 15 years’ service, was dismissed for alleged gross misconduct. The organisation cited failure to follow instructions about a barrier and abusive language. The WRC found the dismissal unfair, in part because the two people who made the allegations were involved throughout the disciplinary process and no investigation was carried out. It also found the dismissal disproportionate where the barrier policy had not been applied consistently.
The WRC found that the worker contributed to a large degree to his dismissal and made no effort to mitigate his losses. It awarded €9,650 in compensation. The organisation accepted that it had not given the required notice; the WRC directed it to pay a further €6,176, equivalent to eight weeks’ pay.
