WRC says it cannot decide worker’s claim over income protection plan

Workplace Relations Commission ·

The Workplace Relations Commission found it could not give a substantive decision on a general operative’s claim over an income protection benefit under a pension scheme. The decision was dated 27 April 2018; the merits of the entitlement were not decided. The worker said the benefit had been part of his employment terms through successive business transfers. The respondent argued that the plan was not included in the terms transferred to it and that invalidity benefits under a pension scheme fell outside the regulations. The officer found the claim concerned a benefit under a “Retirement Plus Plan” and could not be decided by an adjudicator.
