WRC awards sales assistant €7,500 after unfair dismissal following maternity leave

Workplace Relations Commission ·

The Workplace Relations Commission awarded a sales assistant €7,500 after finding she was unfairly dismissed following her return from maternity leave. Adjudication Officer Pat Brady dated the decision 2 February 2018. The worker said she was offered very little work after telling her manager she was ready to return. She said an email told her there was no more work and her contract was being terminated. The retailer said it understood she had been unavailable for work or had refused shifts. The WRC found that she remained an employee while available for work and that the email ended her employment. It said the retailer used no termination process and had relied at the hearing on an explanation that had not been given at the time. The complaint was upheld and €7,500 was awarded, subject to statutory deductions.
