The Workplace Relations Commission did not uphold a transport company worker’s redundancy complaint, finding that she had formally resigned and her position had not been made redundant. The decision was dated 31 January 2018. The worker said the company had no work for her when she sought to return from adoptive leave and asked her to sign a resignation letter. The company said she did not wish to return and that her position remained in place. The adjudicator accepted evidence from both sides but found the circumstances did not meet the statutory definition of redundancy.
