The WRC found that a facilities management company’s dismissal of a head chef was related in some measure to a business transfer and awarded him five weeks’ pay. The decision was dated 16 May 2018. The chef’s fixed-term contract was due to end on 11 February 2017, but his employment continued for two weeks beyond that date before the company dismissed him. The adjudicator found the company’s explanation of a paperwork error implausible and said the continuation without notice increased the chef’s expectation of continued employment. Four other complaints concerning terms and conditions, employee representation, consultation and information were not well founded. The award was described as 25% of his earnings with the transferor and transferee.
