The WRC found it had no jurisdiction to hear three complaints brought by a head chef against a nursing home over consultation and the transfer of his employment terms. The decision was dated 17 May 2018; the complaints’ merits were not decided. The nursing home contracted out catering, laundry and cleaning work, and 16 employees transferred to a facilities company on 6 February 2017. The head chef said the nursing home had not properly consulted staff or ensured his terms transferred. The officer found that employment liabilities passed to the new employer on the transfer date, so the complaints against the nursing home could not proceed.
