WRC rejects general assistant’s constructive dismissal complaint

By Niamh Kearney

Workplace Relations Commission ·

The WRC rejected a general assistant’s constructive dismissal complaint after finding she resigned voluntarily. The decision was dated 1 June 2018. Her discrimination complaint was deemed withdrawn, and her Terms of Employment complaint was withdrawn. The worker said she felt forced to resign during a disciplinary process over an allegation that she took a bottle of water without paying. The retail multiple said the investigation was ongoing and her resignation was voluntary. The adjudication officer found there were reasonable grounds to investigate the alleged policy breaches and that no dismissal decision had been made when she resigned. The decision did not determine whether she committed the alleged misconduct.
