Workplace Relations Commission ·

The Workplace Relations Commission awarded an office administrator €35,000 for unfair dismissal by a manufacturing company, finding that she had not resigned. The decision was dated 26 February 2018.

She had worked for the company for more than 20 years. She said workplace difficulties led to certified sick leave and that she was dismissed without explanation. The company said she had told a director she would not return. The adjudication officer accepted her evidence that she had not resigned; the director was not at the hearing to give evidence, and the company had received no written resignation.

The officer cited the lack of a recognised management structure and HR procedures, and the managing director’s failure to respond to her communications. The company accepted that annual leave and payment for two public holidays were due. The WRC directed €505.51 for annual leave, €291.36 for the holidays and €3,642 for five weeks’ notice pay. The company later advised that the annual-leave and public-holiday payments had been made.
