WRC awards retail assistant €1,200 for unfair dismissal

Workplace Relations Commission ·

The Workplace Relations Commission awarded a retail assistant €1,200 for unfair dismissal by a retail shop. It rejected his two Payment of Wages complaints and recorded that he withdrew his holiday pay complaint. Adjudication Officer Emile Daly dated the decision 31 May 2018. The assistant said he had been dismissed after raising concerns about unpaid wages; the shop manager said he resigned. The WRC found the manager had trained another employee to replace him and that his dismissal was unfair. It also found the parties had discussed about €450 gross a week for the early shift and Saturdays, rather than the €450 net the assistant understood. The minimum notice complaint failed because he worked out his notice.
