WRC rejects post-room assistant’s transfer complaint and partially upholds workplace dispute

By Orla Quinn

Workplace Relations Commission ·

The WRC dismissed a post-room assistant’s complaint that a facilities company breached transfer rules, but partially upheld his separate industrial relations complaint. Adjudication Officer Pat Brady’s decision was dated 5 March 2018. The assistant said changes after a transfer affected his annual leave, sick pay, conveyancing benefit, workplace policies, insurance information, uniform and bonus, and said he had been penalised for raising concerns. The company denied changing his conditions and described some adjustments as operational or administrative. The WRC found no issue arose under the transfer regulations. It found no change to annual leave, sick pay or bonus terms and noted the company would honour the existing conveyancing arrangement. The assistant was required to cooperate with the company’s general employment policies, including wearing its uniform. The company was recommended to provide an up-to-date statement about his insurance policy, and both sides were asked to work towards resolving the remaining issues within four weeks.
