WRC awards sales manager €1,600 for unlawful wage deduction

Workplace Relations Commission ·

The Workplace Relations Commission awarded a sales manager €1,600 less statutory deductions for an unlawful wage deduction and €627.69 for holiday pay in a decision dated 18 December 2017. Adjudication Officer Eugene Hanly rejected his performance bonus claim and his claim over a tax-refund deduction. The worker said his contract provided for monthly pay of €4,000, but he received €3,600. The company said the difference represented expenses and that a bonus depended on targets he had not met. The WRC found the contract set monthly pay at €4,000 and that the worker was owed €1,600. It also found he was due 3.4 days’ holiday pay. The bonus claim failed because he had no evidence of achieving the targets. The tax-refund overpayment claim failed because he had given written consent to the deduction.
