WRC rejects IT director’s grading complaint against public agency

By Donal Gilhooly

Workplace Relations Commission ·

The Workplace Relations Commission dismissed an IT director’s complaint over his grading at a public agency, finding he was not covered by the agreement he relied on. Adjudication Officer Pat Brady dated the decision 31 May 2018.

The director said an obsolete grade left him about €9,500 behind his peers and sought regrading. The dispute concerned a 2004 agreement for assimilating staff into a new structure after services were reorganised. The agency said he had been acting up and was not eligible for assimilation.

The WRC found that the agreement covered staff with permanent appointments in the relevant posts. The director had been acting up between 2005 and 2008, and his promotion came after the agreement had ceased to apply. The officer also said a 2017 claim could not remedy an alleged grading error dating to 2005.
