Coffee shop worker awarded €1,000 for missed breaks and €840 each for terms and notice

Workplace Relations Commission ·

The WRC awarded a coffee shop worker €1,000 for missed breaks, €840 for inadequate written employment terms and €840 for unpaid notice. It also recommended €2,000 compensation over the dismissal process. The decision was dated 4 April 2018. The worker said he often missed breaks when working alone and received no written terms beyond an email describing a 30-to-35-hour week and an initial rate of €11 an hour. The WRC found the email did not meet the requirement for written terms and that the worker had not received statutory breaks or notice. The dismissal complaint succeeded because the employer gave no investigation, asked for no explanation and offered no right of appeal. The worker withdrew his Payment of Wages complaint.
