The WRC found a customer’s disability discrimination complaint against a takeaway not well founded. In a decision dated 1 June 2018, Adjudication Officer Louise Boyle found no evidence that an employee’s smile was directed at the customer because of his disability, and said the ketchup dispenser did not discriminate against people with disabilities.
The customer said he found the dispenser difficult to use and that staff laughed at him. The takeaway denied discrimination, saying staff tried to show him how to use the dispenser. The officer recommended that the takeaway consider providing customers with directions for using it.
