Bar worker entitled to redundancy lump sum after public house closes

By Rory Hanlon

Workplace Relations Commission ·

A bar worker became entitled to a redundancy lump sum after her public house closed, while five other complaints were found not well founded. The WRC decision was dated 6 June 2018. The worker started on 7 May 2004 and had average gross weekly pay of €289. Her employment ended on 8 October 2017, including notice. The public house did not dispute that redundancy was due, but said the business was insolvent and had applied to the Social Insurance Fund. The lump sum is calculated using those employment dates and weekly pay, subject to the worker having been in insurable employment. The worker had pursued only that claim at the hearing; the other two redundancy complaints and three complaints under the European Communities (Protection of Employment) Regulations 2000 were not pursued and were found not well founded.
