WRC rejects postal operative’s safety penalisation complaint

By Rory Hanlon

Workplace Relations Commission ·

The WRC rejected a postal operative’s complaint that he was penalised for raising safety concerns after refusing to carry a package on his bicycle. The decision was dated 31 May 2018. The operative said the long, narrow package would stick out from his bicycle and that he was unwilling to risk his safety. The postal company said it was a packet within the size limit and that a manager could decide how it should be delivered. It said the warning followed his refusal to deliver it and his interactions with his manager. The adjudication officer accepted that the operative had raised a protected safety concern. The officer found, however, that the manager had investigated the package and believed there was no safety risk. The warning followed the operative’s continued refusal after that check and the way he spoke with the manager. The complaint failed.
