Kitchen porter entitled to redundancy payment after restaurant closed

By Niamh Kearney

Workplace Relations Commission ·

The WRC found that a kitchen porter was entitled to a statutory redundancy payment after the restaurant where she worked closed. The decision was dated 15 May 2018. She had worked at the restaurant since September 2010 and went on sick leave in 2016, intending to return. The business later closed and its staff were let go. The WRC found she remained employed until her P45 issued on 30 April 2017, and that she had worked longer than the 104 weeks required for redundancy entitlement. The decision records a gross weekly wage of €243 for the calculation. She withdrew her separate unfair dismissal complaint.
