The Workplace Relations Commission rejected a security worker’s complaints of race discrimination, victimisation and unequal pay against a security company, in a decision dated 13 June 2023. The worker said he was not transferred to a data centre site, was passed over for promotion and was paid less than Irish supervisors there because of his race. He also alleged harassment and victimisation. The company denied treating him differently and said the sites had different duties, clients and pay rates. The WRC found no evidence in the relevant period to support discrimination claims about transfer, promotion, working conditions or harassment, and found no evidence of a protected act to support victimisation. It also found that the pay difference between sites did not establish an equal pay complaint, given the different work and client circumstances.
