The Workplace Relations Commission found Joe Burns’s complaint against Dún Laoghaire Rathdown County Council was not well founded because he lacked standing under the Fixed-Term Work Act. The merits were not decided. Burns, a Staff Officer with the Council since 2000, alleged he was denied promotion and training after an earlier case and moved to cemetery work. The Council argued he was a permanent employee and could not bring a complaint under the Act. The WRC decision, made by adjudication officer Jim Dolan, was dated 20 July 2023. Dolan relied on a 2017 Labour Court determination that Burns was a permanent employee and lacked standing to bring a claim under the Act.
