The Workplace Relations Commission found that Barbora Rochlova was not unfairly dismissed after National Pen Promotional Products Limited t/a National Pen made her redundant. Her separate parental-leave complaint was withdrawn. The decision was dated 3 July 2023. Rochlova argued that the redundancy was predetermined, consultations were inadequate and alternatives were not properly considered. The company said a Covid-related downturn led to 107 redundancies and that alternatives had been considered. The adjudicator found that a redundancy situation existed and that the evidence did not establish unfair dismissal. The parental-leave complaint was withdrawn by agreement at the start of proceedings.
