The Workplace Relations Commission found Peter Freeman’s complaint under transfer-of-undertakings rules was not well founded. The decision was dated 10 July 2023. Freeman said he had been told his security job at the Jamestown site would transfer to Active Security Management, but was turned away when he arrived on 1 July 2020. His former employer, Securway At risk Security Group Limited t/a Sar Group, offered him work at Beaumont Hospital; he said the journey was less convenient and cost him €50 in taxi fares. The WRC found that the outgoing contractor’s service agreement had ended, the incoming company supplied its own staff, and no assets had transferred. It concluded that there had been no transfer of an undertaking under the regulations, so Freeman’s complaint failed.
