The Workplace Relations Commission found that three of Helena Davis’s complaints against Dye and Durham Hibernian Legal International failed. The decision, dated 7 September 2022, concerned alleged underpayment during lay-off, a change to her terms of employment and discrimination. Five other complaints were withdrawn. The adjudicator found no unlawful wage deductions because Davis’s contract provided for lay-off. Her terms complaint failed because she provided no evidence of a change to her contract apart from pandemic restrictions. Her equality complaint failed because she could not identify a ground of discrimination and did not establish a prima facie case. Davis had alleged underpayment during lay-off, discrimination and breaches of obligations under the Terms of Employment Act. The respondent said the contract and handbook provided for lay-off and described the criteria used to select her. Davis resigned in May 2021 and later confirmed her resignation.
