The Workplace Relations Commission found Brian Mullally was unfairly dismissed by Gleeson Concrete Unlimited Company Gleeson Concrete and awarded him €7,000 compensation. The decision, dated 19 May 2023, also found Mullally was an employee, despite the company’s argument that he was not. Mullally said the company told him it would not need him after Christmas because he had bought concrete from a rival firm for work on his home. The adjudicator accepted that he was dismissed for allegedly buying concrete from a rival firm and found he was not given a chance to state his case or appeal. Compensation was chosen because the employment relationship had irretrievably broken down.
