The Workplace Relations Commission found Kieran Scullion’s constructive unfair dismissal complaint against Corajio Unlimited Company trading as Mr Price Branded Bargains not well founded. The decision was dated 12 June 2023. Scullion said he was sidelined and undermined after returning to work and had no option but to resign. The company said it had honoured its undertakings and invited him to use its grievance procedures. The WRC found that the company had acted in line with its undertakings, reinstated him at the same grade and rate of pay, and acted reasonably. It said using internal procedures is essential to a constructive dismissal claim and found his resignation unreasonable because management had not been given the opportunity to address his concerns.
