The Workplace Relations Commission found against Rodolpho Dos Santos in all three complaints against The Dublin Lager Company T/a Larkin's Brewing Company. Its decision, dated 19 May 2023, found his unfair dismissal complaint not well founded, although his employment ended outside probation. The adjudicator concluded that performance concerns and steps taken by the company meant the dismissal was not unfair. Dos Santos also claimed unlawful wage deductions and a breach of the Terms of Employment (Information) Act over an additional €2,000 he said he was due. The company denied the complaints. The adjudicator found he did not take up a proposed international sales role that carried a higher salary, so he was not entitled to the extra pay. Both complaints were found not well founded.
