The WRC found it had no jurisdiction to hear a social care worker’s dispute over being rostered for night duty. Adjudication Officer Marie Flynn dated the decision 1 February 2022; the merits were not decided. The worker argued that rolling night shifts changed her established contract. The charity said her relief contract covered days, nights and weekends, and that its 24-hour community services required flexible rosters. The WRC found the dispute concerned hours or times of work within a collective agreement and that the statutory restriction prevented it from investigating the matter.
