The Workplace Relations Commission said a dissolved company could not be a respondent to proceedings over Fiona O'Hara’s claims for redundancy and pay in lieu of notice. The decision was dated 10 January 2023. O'Hara had worked as a merchandiser for Outsource Enterprises Limited, which lost its contract to merchandise the RTÉ Guide in October 2021. She said she was not made redundant and received neither a redundancy payment nor pay in lieu of notice. The company was struck off the register on 5 December 2022. The adjudication officer said she had no authority to issue a decision because the company had ceased to have legal existence. She relied on its directors to meet their obligations so O'Hara could receive the payments to which she was entitled.
