The Workplace Relations Commission found Ajibola Bamindele’s dismissal by Synergy Security Solutions Ltd was unfair and awarded him €7,000 for financial loss. The decision, dated 28 July 2023, said the dismissal was disproportionate. Bamindele was found asleep on duty during a shift when a demonstration was due to take place that evening. He said he was unwell and had taken medication. The company said sleeping on duty was serious and usually resulted in dismissal. The adjudicator considered his long service, clear disciplinary record and mitigating circumstances, and found the company had not shown it considered those factors or an alternative to dismissal. She also found Bamindele contributed to his dismissal. He had found another job at a lower hourly rate, and the €7,000 award for financial loss took his contribution into account.
