The Workplace Relations Commission upheld Barbara Flynn’s redundancy and employment particulars complaints against Guide Friday (Ireland) Limited Dualway Coaches. It ordered a statutory redundancy payment based on weekly earnings of €650 and 45 hours a week, and €2,600 compensation for the missing employment particulars. The decision was dated 13 June 2023. Flynn had been laid off during the Covid-19 period and sought redundancy after she was not returned to work. The adjudication officer found the employer had not served the required counter-notice within seven days and had not returned her to work within four weeks. The decision sets out the basis for calculating the statutory payment but gives no lump-sum figure. The officer also found that the employer could not produce a statement of employment particulars and that a transfer letter did not meet that requirement. The WRC awarded compensation equivalent to four weeks’ pay and directed that payment be made within 42 days.
