The Workplace Relations Commission found Daniel Hayden’s public holiday pay complaint against Bausch Health Ireland Limited t/a Bausch and Lomb not well founded. The decision was dated 7 March 2023. Hayden argued that his pay did not reflect normal pay when he was not rostered on a public holiday, and that he was owed extra pay when a shift crossed a holiday. The company said its calculations complied with the regulations. The adjudication officer found that overtime was correctly excluded when calculating pay for a holiday on which Hayden did not work. For a shift partly falling on a public holiday, the officer found that his pay exceeded the additional day’s pay required by law. The complaint was found not well founded.
