WRC orders Instant Upright to pay former worker €19,185.68 gross

Workplace Relations Commission ·

The Workplace Relations Commission (WRC) ordered Instant Upright to pay former employee David Mc Cormack €19,185.68 gross over unlawful wage deductions. The decision was dated 6 April 2023.

Mc Cormack said he was underpaid during sick leave and was not properly paid contractual notice, commission and allowances when he was made redundant. The WRC found a 40% reduction in his basic pay during sick leave was a deduction, and found a shortfall in his contractual notice pay. It ruled the deductions were not authorised by law or his contract, and that he had not consented to them in writing. The payment is subject to normal statutory deductions and was due within six weeks of the determination.
