The Workplace Relations Commission awarded Sean Hanley €1,638 for a breach of the law requiring employers to provide written employment terms. It also awarded him €1,092 for missed rest breaks and €500 for inadequate notice of additional hours in a decision dated 28 June 2023. Hanley worked as a gate man for Felix O'Hare & Co Ltd, earning €14 an hour for a 39-hour week. He complained about his pay and benefits, working hours, breaks, wages, holidays and employment terms. The company said he was not covered by the construction-sector employment order, had received breaks and had been sent a contract. The officer found the company could not produce a copy of Hanley's contract or show that it had a process for retaining a signed copy. The officer also found that Hanley had received very short or no notice of additional hours and had been denied some rest breaks. Other complaints were found not well founded, including Hanley's claim that the construction-sector order applied to his role. One complaint about working hours was withdrawn at the hearing. The awards were separate remedies for breaches of employment rules.
