The Workplace Relations Commission dismissed Bernadette Brady’s constructive dismissal complaint against Bbowes T/A O ‘Hehir’s, finding it not well founded. The decision was dated 12 July 2023. Brady said she resigned after concerns including unpaid leave, how a supervisor spoke to her, delays in considering a pay rise, a lack of extra shifts and a refused roster change. The employer argued its actions did not justify her resignation and said she had not completed the available grievance process. The adjudication officer found that the late pay rise offer did not establish constructive dismissal and that the employer was not required to change Brady’s hours to accommodate public transport.
