The Workplace Relations Commission awarded Karol Kierschkowski €2,734 for his employer’s failure to provide written employment terms, in a decision dated 20 April 2023. It also ordered PCK Allbuilding Services Limited to pay compensation and a pension contribution on several other complaints. Kierschkowski worked as a trainee bricklayer for the company for 11 weeks in 2022. He said he had not received a statement of his employment terms and was underpaid. The company accepted that it had not issued the terms and that he had missed a public holiday payment, while disputing other claims. The WRC found five complaints well founded and two not well founded. It awarded €100 for a breach of construction-sector sick-pay rules and ordered a €315.15 pension contribution. It also awarded €138.53 for the unpaid public holiday and €191.29 for an hourly-rate shortfall. The WRC found that the company did not have to confirm his plastering duties in writing, and that mobile road transport rules did not apply to his work.
