The Workplace Relations Commission found Gillian Dunne’s constructive dismissal complaint against Teroboc Operations Limited t/a Kinnitty Castle Hotel not well founded. The decision was dated 11 September 2023. Dunne said her shifts fell to one or half a shift a week before she resigned in August 2022. The hotel said she had asked to move from kitchen work to daytime housekeeping and had limited availability because of another job and her preference to have weekends off. The adjudicator accepted that Dunne’s hours were reduced, linking this to her move to housekeeping and her unavailability for afternoons and weekends. The decision also said the hotel did not handle notification of her injury in line with best HR practice, but found its conduct did not justify a constructive dismissal finding.
