The Workplace Relations Commission awarded Estelle Kirby €1,500 after finding her complaint against De Barra Kitchens well founded. The decision, dated 4 August 2023, concerned the employer’s failure to provide statutory statements of employment terms. Kirby said she worked for the business for around four months without receiving a statement setting out her terms. The respondent confirmed that he had not provided either of the required statements, saying he had delayed while uncertain about continuing her employment. The WRC said other difficulties in the working relationship were outside the hearing’s jurisdiction and limited its decision to the terms of employment complaint. Kirby was paid €750 per week.
