The Workplace Relations Commission found Fergus O Rourke was unfairly dismissed by Domac Plant and Tool Hire Ltd and awarded him €2,400 in a decision dated 6 July 2023. O Rourke worked as a mechanic and said he was injured while doing a one-person job in Galway City. He remained unfit for work. The company made no submissions at the hearing, called no witnesses and did not confirm or deny that the dismissal was unfair. The adjudicator found O Rourke was dismissed without fair procedures. As he remained unfit for work, the decision found no loss had accrued under the Act and awarded €2,400, the maximum of four weeks’ remuneration in those circumstances.
